Conclusion of contract

Once the Customer places an order in the Online Shop, the Customer will send a contractual proposal of purchase to GUESS, which does not constitute the termination of the contract. GUESS will send a confirmation of receipt of the order to the Customer by e-mail. Such e-mail does not constitute an acceptance of the proposal, but only confirmation of receipt of the order, after which GUESS may confirm the availability of the Product(s) and, if applicable, verify the payment method indicated.

The contract for the sale and purchase of the Product(s) shall be deemed concluded when the Customer receives the e-mail of successful dispatch of the order, provided that the payment is successful, containing these GCS and information about the Product(s) ordered, including the price paid. If, for any reason, payment of the price is not successful, the order will not be processed and will be cancelled, and the contract will not be concluded.

To make any changes to an order, the Customer must contact Customer Service. GUESS reserves the right to accept, wholly or in part, the changes to the order requested by the Customer, provided that such changes are requested before the ordered products are shipped. Completion of the order form implies the acceptance of the offered price and the general terms and conditions of sale in force at the time. Once the order has been formalised, the purchase is understood to be fully concluded, with all legal guarantees for the protection of the purchasing consumer and, from that moment, the prices and conditions assume a contractual nature and cannot be modified without the express consent of both contracting parties. The language used for the formalisation of the contract shall be English.

Product prices

1. The prices of our products are expressed in Hungarian forints (HUF).
2. The prices shown in the Online Store include the VAT (Value Added Tax) in force at the time of the order.
3. The prices shown in the Online Store do not include the shipping costs, which shall be paid by the Customer. Shipping costs will be added to the final total price at the time of placing the relevant Order, according to the applicable shipping rates indicated in the Online Store. Additional shipping costs may apply. Any additional shipping costs, where applicable, will be duly indicated at the checkout stage and reported in the FAQ section
4. Payment by Customer may be made using any payment option available in the Online Store:
   1. Credit Card
   2. PayPal
   3. Klarna
   4. Apple Pay
   5. Google Pay

   In the event that the Customer makes use of payment services offered by third party operators (for example Klarna or Paypal), the Customer is required to read the terms and conditions governing such services.

5. Payment by credit card may be subject to the application of fees by the Customer's bank or the company that issued the credit card and the Customer may have more information about these fees by contacting their bank and the company issuing their credit card. GUESS remains totally unrelated to purchase transaction fees, which depend on the specific conditions applied, to its customers and users, by the providers of banking and payment services.

Right of withdrawal from a distance contract

1. The Customer, without having to provide any reason, may withdraw from the distance contract stipulated with GUESS and return the products purchased through the Online Store within 30 calendar days from the day of receipt of the products ordered or, in the case of products subject to the same order that have been received separately, from the day of receipt of the last product. In order to comply with the deadline for exercising the withdrawal, it is sufficient for the Customer to send Guess a relevant explicit written notice of their intention to withdraw from the contract within the 30-day period indicated above.
2. To exercise the right of withdrawal, Guess recommends activating the electronic procedure available in the MY ACCOUNT or RETURNS sections of the Online Store.

   Should the Costumer prefer not to make use of the aforementioned procedure, the notice of withdrawal from the contract may also be submitted using the following form, which, by way of illustration, outlines the information and data that must be provided to Guess in order to withdraw.

3. GUESS will promptly send the Customer an acknowledgment of receipt of the notice of withdrawal on a durable medium (for example, by email).
4. In case of withdrawal from the contract, GUESS shall reimburse the Customer for all payments received in connection with the order, including delivery costs, if incurred. Additional costs incurred by the Customer who has expressly chosen a delivery method other than the least expensive type offered by GUESS shall not be reimbursed.
5. Without prejudice to the paragraph 6 below, the reimbursement to the Customer shall be made by GUESS without delay, and, in any case, no later than 14 days from the day on which GUESS was informed of the Customer’s decision to withdraw. The timeframe for the actual crediting of the amount due to the Customer depends on the Customer’s credit institution or on third-party payment service providers (such as PayPal or Klarna) and is in no way managed or controlled by GUESS. GUESS shall reimburse the payment only to the Costumer who placed the order, using the same payment method chosen by the Customer at the time of the conclusion of the contract, unless the Customer has expressly agreed otherwise. In any case, the Customer shall not bear any costs in obtaining the reimbursement.
6. GUESS reserves the right to withhold the amount to be reimbursed until it receives the goods at the address indicated in paragraph 7 below, or until the Customer provides proof of shipment of the goods, whichever occurs first.
7. The products to be returned must be shipped to the following address GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Poland in a single shipment and within fourteen [14] calendar days from the day on which the Customer notified GUESS of their intention to withdraw from the contract. The products may be shipped using the return label automatically generated after completing the return registration procedure as described on the Online Store(or the return label otherwise provided by GUESS to the Customer together with the ordered products). The Customer may choose any method for returning the products and shall bear the related shipping costs. Customers who make use of GUESS’s return procedure are entitled to one (1) free return shipment per month. GUESS strongly recommends including the order number and order date in the return package, to allow GUESS to identify the shipment and proceed with the return process. The right of withdrawal does not apply to sealed products that are not suitable for return due to health protection or hygiene reasons and that have been opened after delivery: in such case, GUESS reserves the right to refuse the return, with the consequences set out in paragraph 9 below.
8. The Customer shall be liable for any reduction in the value of the product resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the product. This means that, following the Customer’s withdrawal from the contract, GUESS may seek compensation from the Customer for any damage caused by the return of products that are not intact or have been altered (e.g., damaged, washed, incomplete). All returned items must be unused and in their original condition, with all tags and labels intact.
9. Should GUESS refuse the return due to the ineligibility of the request (for example, if the time limit for the Customer to make the return has expired) or of the Product (for example, in the case of products that cannot be returned pursuant to paragraph 7 above), GUESS shall return the products to the Customer — unless the Customer explicitly communicates otherwise — at the Customer’s expense, and no reimbursement shall be issued.

Legal Warranty of Conformity

1. In the event of delivery of defective products by GUESS, according to the legal warranty, the Customer shall be entitled to the following remedies:
   1. price reduction;
   2. reimbursement of the price (termination of the contract);
   3. replacement of the defective products;
   4. repair of the products.
2. The warranty is valid for 3 (three) years starting from the date the products are delivered to the Customer. The action aimed at asserting defects not fraudulently concealed by GUESS must, in any case, be brought within thirty-eight months from the date of delivery of the Product. The Customer must report the defect to Guess within 2 months from the date the defect is discovered.
3. Unless proven otherwise, any lack of conformity that arises within one year from the delivery of the Product is presumed to have already existed at the time of delivery, unless this assumption is incompatible with the nature of the Product or the nature of the lack of conformity. After one year from the delivery of the Product, it will be the Customer’s responsibility to prove that the lack of conformity already existed at the time of delivery.
4. In order to benefit from the legal warranty, the Customer must provide proof of the purchase and date of delivery of the goods. Therefore, for this purpose, it is advisable that the Customer retains the purchase invoice, as well as the transport document or any other document that can certify the purchase and the date of delivery.
5. Notwithstanding the above, any faults or malfunctions caused by external and accidental events or by the Customer’s responsibility or by use of the Product that does not comply with its intended use and/or with the provisions of the documentation accompanying the Product are excluded from the scope of the legal warranty.
6. In the event of a lack of conformity covered by the legal warranty, the Customer is entitled to:
   1. (i) primarily, have the product repaired or replaced free of charge, at their choice, unless the requested remedy is objectively impossible or excessively onerous compared to the alternative;
   2. (ii) secondarily, a proportional price reduction or termination of the contract (with reimbursement by GUESS of the amount paid by the Customer for the purchase of the Product), at their choice, in the event that:
      • • GUESS has not carried out the repair or replacement, or has refused to do so because it is impossible or excessively onerous;
      • • a lack of conformity appears despite GUESS’s attempt to restore the conformity of the product;
      • • the lack of conformity is so serious as to justify the immediate price reduction or the termination of the sales contract; or
      • • GUESS has declared, or it is clear from the circumstances, that it will not restore the conformity of the product within a reasonable period of time or without significant inconvenience to the Customer.
7. Without prejudice to the other remedies, GUESS may oppose the termination of the contract if it proves that the lack of conformity is only minor.
8. In the event that the Customer, according to the legal warranty, requests a refund or a price reduction, the following provisions shall apply: upon receipt of the Products by Guess at the following address: GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Poland, and after GUESS has verified the existence of any defects, GUESS will send an email to the Customer confirming the receipt of the defective products, will give instructions for the refund to the bank or third-party payment service provider (such as PayPal or Klarna) requesting the refund of the price (total or partial) and of all shipping costs (including shipping costs for the return of the product) within no more than 14 days after the receipt of the refund. The actual time required for the amount to be credited to the Customer depends on the Customer’s bank or third-party payment service providers (such as PayPal or Klarna) and is beyond GUESS’s control.

Complaints

1. In order to file a complaint (for a defective product or for any other case), the Customer may:
   1. File a complaint online. To activate this option, the Customer must contact Customer Service at https://www.rag-bone.eu/-/need-help. Customer Service may request a photo of the products and the alleged defect. Customer Service reserves the right to make available to the Customer a courier label that will allow products to be sent to GUESS by courier at the expense of the latter. GUESS recommends the use of the online complaint form, which ensures immediate feedback for the Customer.
   2. As an alternative to the process illustrated in the preceding paragraph, the Customer may use the following form:

2. GUESS will respond to the Customer's complaint immediately, no later than 14 calendar days from its receipt. Failure to respond by GUESS within the aforementioned period implies the automatic acceptance of the Customer's complaint. GUESS will inform the Customer without delay of any unsuitability of the complaint and/or of any need to supplement it with missing information and data.
3. In any case, the possibility remains for the Customer to activate extrajudicial methods of handling complaints according to the online dispute resolution procedure prepared by the European Commission. The relevant platform is available at the following link: https://ec.europa.eu/consumers/odr.

License

1. With these GCS, GUESS grants the Customer a non-exclusive, non-transferable, non-sublicensable, and limited right to use the Online Store in accordance with the methods expressly permitted by the Online Store and governed by these GCS. The Customer must comply with any limitations present on the Online Store without altering in any way the Online Store. In particular, except as provided by mandatory legal provisions, the Customer will refrain from the following activities by way of example: bypassing technical limitations of the Online Store; decoding, decompiling, or disassembling the Online Store; etc.
2. It is expressly understood that GUESS reserves all rights not specifically licensed in accordance with these GCS.
3. Except as expressly permitted by these GCS, the Customer may not: (i) use the Online Store to provide any commercial service; (ii) use the Online Store to develop a product that competes with the Online Store or with GUESS; (iii) use automated access tools such as spiders or robots, or engage in scraping activities in relation to the Online Store, or collect information and data from the Online Store; (iv) allow third parties to access or use the Online Store unless otherwise provided by these GCS; (v) distribute or publish their Online Store login credentials; or (vi) use unauthorized or third-party login credentials.

Website content and use - Intellectual Property

1. The Online Store and its contents are property of GUESS and its licensors.
2. The Online Store and its contents are protected by the national and international laws regarding copyright, registered trademarks, designs and models, software protection, databases, domain names, or any other intellectual and industrial property rights legislation.
3. The Customer may not reproduce, except for purposes related to personal use and within the limits established by applicable laws, publish, communicate to the public by any means of communication, transmit, perform, display, distribute, remove, delete, add to, or otherwise modify the Online Store or its content, nor create works inspired by or derived from them, commercialize the Online Store and/or its content, or actively participate in their commercialization, unless expressly and in advance authorized by GUESS.
4. It is expressively prohibited to damage, interfere with or disrupt access to the Online Store and its content, or to perform actions that may alter its functionality or interfere with other users’ access of to the Online Store or its content, nor utilize the Online Store or its content in illegal manners or in a way harmful to GUESS and to any third party, including any other user of the Online Store.
5. The web pages that make up the Online Store may allow access, via dedicated hyperlinks (namely, links) to third-party website or resources available on the Internet. GUESS shall not be held liable for the actual accessibility of third-party websites linked through such hyperlinks, nor for any damages that may arise to the Customer and/or users in connection with the contents, materials or Products offered or obtained by the Customer through the said websites.

Exclusion of warranty and limitation of liability

1. Through the utilization of the Online Shop, the Customer acknowledges and agrees that the Online Shop is furnished “as it is” and “as available” at the time of fruition.
2. GUESS, to the fullest extent permitted by applicable law and without prejudice to the provisions of this section, does not provide any warranty, express and/or implied, in relation to the Online Shop, such as, by way of example only, any warranty of harmlessness from harmful software (i.e. malware and/or viruses of any kind and by way of example only file viruses, boot viruses, macro viruses and network viruses) or any warranty of merchantability or fitness for particular purposes.
3. GUESS cannot be held liable in any way for any damage deriving from the use of the Online Shop and from the purchase and/or use of the Products, unless otherwise provided for by applicable law.
4. Any content downloaded, created or otherwise acquired from or through the Online Shop is obtained at the sole and exclusive discretion and risk of the Customer. The Customer is therefore solely and exclusively liable for any damage to your devices or loss of data resulting from the use of the Online Shop. To the fullest extent permitted by applicable law, by using the Online Shop, the Customer undertakes to bear all the risks connected to such use and to assume full responsibility for any loss of use, loss of data and costs connected to any servicing and/or repair of the hardware and/or software used in connection to the Online Shop, also undertaking not to hold GUESS liable in any way for any damage arising from or caused by the use of this Online Shop or related to it.
5. Notwithstanding any other provision in this GCS, the warranties and liability of GUESS are not excluded or limited: (i) in case of death or damage to the Customer resulting from the act or omission of GUESS; (ii) in case of negligence or wilful misconduct of GUESS; (iii) for any other liability or warranty that cannot be limited or excluded by law.

Indemnity

To the fullest extent permitted by applicable law, the customer undertakes to indemnify and hold GUESS, its affiliates, administrators, directors, officers and assigns harmless from any and all liability resulting from pecuniary or non-pecuniary loss suffered by any third party in any way (i) arising from the negligent use of the Online Shop and the Products, or otherwise in breach of any article of these GCS, or (ii) arising from the breach of any applicable law or any third party right.

Final dispositions

1. In the event that any provision of these GCS is found to be invalid or ineffective, this shall not render these GCS invalid in its entirety. Any invalid provisions shall be replaced by other valid provisions, taking into account the will of the parties and the meaning and content permitted by applicable law.
2. These GCS comprise the entire agreement between the Customer and GUESS and supersede any previous or contemporaneous conditions, agreements or statements, whether oral or written, relating to the subject matter of these GCS.
3. Neither the Customer nor GUESS shall be deemebe in fault under these GCS due to any delay or failure to perform its obligations resulting from any event beyond the reasonable control of the Customer or GUESS (so-called ‘Force Majeure’), provided that the party concerned notifies the other party in a reasonably timely manner of the Force Majeure condition and makes reasonable efforts to mitigate the delay or failure.
4. Guess takes into particular consideration and pays maximum attention to the protection of the Customer’s personal data. GUESS processes the Customer’s personal data in compliance with the provisions of the applicable law and in accordance with its privacy policy accessible at the link ‘Privacy’ that can be found in the Online Shop and that forms an integral and substantial part of these GCS.
5. These GCS are subject to Hungarian law. Any disputes arising therefrom shall be subject to the jurisdiction of the competent court based on the place of residence of the Customer.

Szerződés megkötése

Amint a Vásárló megrendelést ad az Online Áruházban, vásárlási szerződési ajánlatot küld a GUESS-nek, ami nem jelenti a szerződés megkötését. A GUESS e-mailben küldi meg a megrendelés visszaigazolását a Vásárlónak. Az e-mail nem jelenti az ajánlat elfogadását, hanem csupán a megrendelés kézhezvételének visszaigazolását, amely után a GUESS megerősítheti a Termékek rendelkezésre állását, és szükség esetén ellenőrizheti a megjelölt fizetési módot.

A Termékek értékesítésére és megvásárlására vonatkozó szerződés akkor tekintendő megkötöttnek, amikor a Vásárló megkapja a megrendelés sikeres kiszállításáról szóló e-mailt, feltéve, hogy a fizetés sikeres volt, amely tartalmazza az ÁÉF-et és az információkat a megrendelt Termékekről, beleértve a fizetett árat is. Ha bármilyen okból a fizetés nem sikerül, a megrendelést nem dolgozzák fel, és törlik, így a szerződés nem jön létre.

A megrendelés bármilyen módosításához a Vásárlónak az Ügyfélszolgálattal kell kapcsolatba lépnie. A GUESS fenntartja a jogot, hogy teljes egészében vagy részben elfogadja a Vásárló által kért megrendelésmódosításokat, feltéve, hogy azokat a megrendelt termékek kiszállítása előtt kérik. A megrendelési űrlap kitöltése magában foglalja az ajánlott ár és az érvényben lévő általános értékesítési feltételek elfogadását a megrendelés időpontjában. Miután a megrendelést formálisan megtették, a vásárlás teljesen lezártnak tekintendő, az összes jogi garanciával a vásárló fogyasztó védelme érdekében, és ettől a pillanattól az árak és feltételek szerződési jellegűvé válnak, és nem módosíthatók a szerződő felek kifejezett hozzájárulása nélkül. A szerződés formális nyelve az angol nyelv lesz.

Termékárak

1. A termékek ára magyar forintban (HUF) pénznemben van meghatározva.
2. Az Online Áruházban feltüntetett árak tartalmazzák a megrendelés időpontjában érvényes ÁFA-t (értékesített termék áfája).
3. Az Online Áruházban feltüntetett árak nem tartalmazzák a szállítási költségeket, amelyeket a Vásárlónak kell fizetnie. A szállítási költségek a megfelelő megrendelés leadásakor kerülnek hozzáadásra a végső teljes árhoz, az Online Áruházban feltüntetett érvényes szállítási díjak szerint. További szállítási költségek is alkalmazhatók. Ahol alkalmazható, bármely további szállítási költség a fizetési folyamat során megfelelően feltüntetésre kerül, és a GYIK szakaszban is szerepel.
4. A Vásárló fizetése az Online Áruházban elérhető bármely fizetési lehetőséggel történhet:
   1. Hiteleszkártya
   2. PayPal
   3. Klarna
   4. Apple Pay
   5. Google Pay

   Amennyiben a Vásárló harmadik fél által nyújtott fizetési szolgáltatásokat használ (pl. Klarna vagy Paypal), a Vásárló köteles elolvasni az ilyen szolgáltatásokra vonatkozó feltételeket.

5. A hiteleszkártyával történő fizetés díjakat vonhat maga után, amelyeket a Vásárló bankja vagy a hitelkártyát kibocsátó vállalat alkalmaz, és a Vásárló további információkat szerezhet be ezekről a díjakról, ha kapcsolatba lép a bankjával és a hitelkártyáját kibocsátó vállalattal. A GUESS teljesen független a vásárlási tranzakciók díjaitól, amelyek a banki és fizetési szolgáltatók által alkalmazott speciális feltételektől függenek, amelyeket azok az ügyfeleikre és felhasználóikra alkalmaznak.

Távollévők közötti szerződésből való visszalépés joga

1. A Vásárló indoklás nélkül visszaléphet a GUESS-szel kötött távollévők közötti szerződéstől, és visszaküldheti a termékeket, amelyeket az Online Áruházon keresztül vásárolt, a megrendelt termékek kézhezvételétől számított 30 naptári napon belül, vagy abban az esetben, ha ugyanazon megrendeléshez tartozó termékeket külön-külön kapta meg, az utolsó termék kézhezvételétől számított 30 napon belül. A visszalépési jog gyakorlásának határidejének betartásához elegendő, ha a Vásárló a fenti 30 napos határidőn belül írásban, egyértelműen értesíti a GUESS-t a szerződéstől való visszalépési szándékáról.
2. A visszalépési jog gyakorlásához a GUESS javasolja az Online Áruház SAJÁT FIÓKOM vagy VISSZATÉRÉSEK szakaszában elérhető elektronikus eljárás aktiválását.

   Ha a Vásárló nem kívánja az említett eljárást használni, a szerződéstől való visszalépésről szóló értesítés az alábbi űrlap használatával is benyújtható, amely példaként tartalmazza azokat az információkat és adatokat, amelyeket a Vásárlónak a GUESS-nek meg kell adnia a szerződéstől való visszalépéshez.

3. A GUESS haladéktalanul visszaigazolja a visszalépésről szóló értesítés kézhezvételét a Vásárlónak tartós adathordozón (pl. e-mailben).
4. A szerződéstől való visszalépés esetén a GUESS visszatéríti a Vásárlónak a megrendeléssel kapcsolatban kapott összes fizetést, beleértve a szállítási költségeket is, ha azok felmerültek. A Vásárló által kifejezetten a GUESS által kínált legolcsóbb típusú szállítási módtól eltérő szállítási mód választásából eredő további költségeket nem térítik vissza.
5. A lenti 6. bekezdés sérelme nélkül, a visszatérítést a GUESS haladéktalanul, és minden esetben legkésőbb 14 napon belül elvégzi a Vásárlótól a visszalépési döntésről való értesítés napjától számítva. A Vásárló számlájára történő tényleges jóváírás időtartama a Vásárló hitelintézetétől vagy harmadik fél fizetési szolgáltatóitól (pl. PayPal vagy Klarna) függ, és semmilyen módon nincs a GUESS irányítása vagy ellenőrzése alatt. A GUESS csak annak a Vásárlónak téríti vissza a fizetést, aki a megrendelést leadta, és ugyanazt a fizetési módot használja, amelyet a Vásárló a szerződéskötéskor választott, kivéve, ha a Vásárló kifejezetten másképp ért egyet. Minden esetben a Vásárló nem visel költséget a visszatérítésért.
6. A GUESS fenntartja a jogot, hogy visszatartsa a visszatérítendő összeget addig, amíg a lenti 7. bekezdésben megadott címen meg nem kapja az árut, vagy amíg a Vásárló nem nyújt be bizonyítékot az áruk kiszállításáról, attól függően, hogy melyik következik be előbb.
7. A visszaküldendő termékeket a GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Lengyelország címre kell küldeni egyetlen szállítmányban, és a Vásárló által a szerződéstől való visszalépési szándékának közlésétől számított tizennégy (14) naptári napon belül. A termékek visszaküldhetők az Online Áruházban leírtak szerint a visszaküldési regisztrációs eljárás befejezése után automatikusan generált visszaküldési címke használatával (vagy a GUESS által másképp a Vásárló számára a megrendelt termékekkel együtt biztosított visszaküldési címke használatával). A Vásárló bármilyen módszert választhat a termékek visszaküldésére, és viseli a kapcsolódó szállítási költségeket. A GUESS visszaküldési eljárását használó Vásárlók jogosultak havonta egy (1) ingyenes visszaküldési szállítmányra. A GUESS határozottan javasolja, hogy a Vásárló a visszaküldési csomagba tegye bele a megrendelés számát és a megrendelés dátumát, hogy a GUESS azonosítani tudja a szállítmányt, és folytathassa a visszatérítési folyamatot. A visszalépési jog nem vonatkozik azokra a lezárt csomagolású termékekre, amelyek egészségvédelmi vagy higiéniai okokból nem alkalmasak visszaküldésre, ha a kézbesítés után megnyíltak: ilyen esetben a GUESS fenntartja a jogot, hogy elutasítsa a visszaküldést, a lenti 9. bekezdésben meghatározott következményekkel.
8. A Vásárló felelős minden olyan értékcsökkenésért, amely a termék használatából ered, amely meghaladja annak a termék természetének, jellemzőinek és működésének megállapításához szükséges mértéket. Ez azt jelenti, hogy a Vásárló szerződéstől való visszalépését követően a GUESS kártérítést igényelhet a Vásárlótól a nem sértetlen vagy megváltoztatott (pl. megsérült, kimosott, hiányos) termékek visszaküldése miatt okozott bármely kárért. Minden visszaküldött tétel használatlan állapotban, eredeti állapotában, minden címkéjével és matricájával együtt kell, hogy legyen.
9. Ha a GUESS elutasítja a visszaküldést a kérés alkalmatlansága (pl. ha a Vásárló visszaküldésére vonatkozó határidő lejárt) vagy a Termék alkalmatlansága (pl. ha a fenti 7. bekezdés szerint nem lehet visszaküldeni a termékeket) miatt, a GUESS visszaküldi a termékeket a Vásárlónak – kivéve, ha a Vásárló kifejezetten másképp közli – a Vásárló költségén, és nem történik visszatérítés.

Jogi megfelelőségi garancia

1. Amennyiben a GUESS hibás termékeket szállít, a jogi garancia szerint a Vásárló a következő jogokat élvezheti:
   1. árleszállítás;
   2. ár visszatérítése (a szerződés megszüntetése);
   3. a hibás termékek cseréje;
   4. a termékek javítása.
2. A garancia a termékek Vásárlónak történő kézbesítésétől számított 3 (három) évre érvényes. A GUESS által nem csalárd módon eltitkolt hibák érvényesítésére irányuló igényt mindenképpen a Termék kézbesítésétől számított harmincnyolc hónapon belül kell benyújtani. A Vásárlónak a hibát a hiba felfedezésétől számított 2 hónapon belül be kell jelentenie a GUESS-nek.
3. Kivéve, ha az ellenkezője bizonyított, a Termék kézbesítésétől számított egy éven belül fellépő bármely megfelelőségi hiányosság feltételezhetően már a kézbesítés időpontjában fennállt, kivéve, ha ez az állítás összeegyeztethetetlen a Termék vagy a megfelelőségi hiányosság természetével. A Termék kézbesítésétől számított egy év elteltével a Vásárló felelős a megfelelőségi hiányosság kézbesítés időpontjában való fennállásának bizonyításáért.
4. A jogi garancia igénybevételéhez a Vásárlónak bizonyítania kell a vásárlást és az áruk kézbesítésének dátumát. Ezért e célból ajánlott, hogy a Vásárló megőrizze a vásárlási számlát, valamint a szállítási dokumentumot vagy bármely más dokumentumot, amely igazolhatja a vásárlást és a kézbesítés dátumát.
5. Fenti rendelkezések ellenére kizárólagosan nem tartoznak a jogi garancia hatálya alá a külső és véletlen eseményekből vagy a Vásárló felelősségéből eredő, illetve a Termék rendeltetésszerű használatával és/vagy a Termékkel együtt szállított dokumentáció rendelkezéseivel összhangban nem lévő használatból eredő hibák vagy meghibásodások.
6. Amennyiben a jogi garancia hatálya alá tartozó megfelelőségi hiányosság áll fenn, a Vásárló jogosult:
   1. (i) elsősorban, a termék ingyenes javítására vagy cseréjére, a választása szerint, kivéve, ha a kért intézkedés tárgyilagosan lehetetlen vagy aránytalanul túlterhelő az alternatívához képest;
   2. (ii) másodsorban, arányos árleszállításra vagy a szerződés megszüntetésére (a GUESS által a Termék megvásárlásáért fizetett összeg visszatérítésével), a választása szerint, abban az esetben, ha:
      • • a GUESS nem hajtotta végre a javítást vagy a cserét, vagy megtagadta végrehajtásukat, mert az lehetetlen vagy aránytalanul túlterhelő;
      • • a megfelelőségi hiányosság a GUESS megfelelőség helyreállítására irányuló kísérlete ellenére is fennáll;
      • • a megfelelőségi hiányosság annyira súlyos, hogy azonnali árleszállítást vagy az értékesítési szerződés megszüntetését igazolja; vagy
      • • a GUESS kijelentette, vagy a körülményekből egyértelműen kiderül, hogy nem fogja helyreállítani a termék megfelelőségét ésszerű időn belül, vagy jelentős kellemetlenség nélkül a Vásárló számára.
7. A többi jogorvoslat sérelme nélkül, a GUESS vitathatja a szerződés megszüntetését, ha bizonyítja, hogy a megfelelőségi hiányosság csak jelentéktelen.
8. Abban az esetben, ha a Vásárló a jogi garancia szerint visszatérítést vagy árleszállítást kér, a következő rendelkezések alkalmazandók: a Termékek GUESS általi kézhezvétele után a következő címen: GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Lengyelország, és a GUESS általi esetleges hibák létezésének ellenőrzése után a GUESS e-mailt küld a Vásárlónak, amely megerősíti a hibás termékek kézhezvételét, utasításokat ad a banknak vagy harmadik fél fizetési szolgáltatójának (pl. PayPal vagy Klarna) a teljes vagy részleges ár és az összes szállítási költség (a termék visszaküldésének szállítási költségei is) visszatérítésére legkésőbb 14 napon belül a visszaküldés kézhezvételét követően. A Vásárló számlájára történő tényleges jóváírás időtartama a Vásárló bankjától vagy harmadik fél fizetési szolgáltatóitól (pl. PayPal vagy Klarna) függ, és a GUESS ellenőrzése alatt áll.

Panaszok

1. Panasz benyújtásához (hibás termék vagy bármely más eset) a Vásárló:
   1. Benyújthatja a panaszát online. Ennek az opció aktiválásához a Vásárlónak kapcsolatba kell lépnie az Ügyfélszolgálattal a https://www.rag-bone.eu/-/need-help címen. Az Ügyfélszolgálat kérheti a termékek és a feltételezett hiba fényképét. Az Ügyfélszolgálat fenntartja a jogot, hogy a Vásárló számára egy futárcímkét biztosítson, amely lehetővé teszi, hogy a termékeket futárral, a GUESS költségén küldje el a GUESS-nek. A GUESS ajánlja az online panaszformanyomtatvány használatát, amely azonnali visszajelzést biztosít a Vásárló számára.
   2. Az előző bekezdésben leírt folyamathoz alternatívaként a Vásárló az alábbi formanyomtatványt használhatja:

2. A GUESS azonnal válaszol a Vásárló panaszára, legkésőbb a kézhezvételét követő 14 naptári napon belül. A GUESS fent említett határidőn belüli válaszának elmaradása a Vásárló panaszának automatikus elfogadását jelenti. A GUESS haladéktalanul tájékoztatja a Vásárlót a panasz alkalmatlanságáról és/vagy a hiányzó információk és adatok kiegészítésének szükségességéről.
3. Mindazonáltal a Vásárló számára továbbra is lehetőség marad az Európai Bizottság által készített online vitarendezési eljárás szerinti, bíróságon kívüli panaszkezelési módszerek aktiválására. A megfelelő platform a következő linken érhető el: https://ec.europa.eu/consumers/odr.

Licenc

1. Az ÁÉF-ekkel a GUESS a Vásárló számára nem kizárólagos, átruházhatatlan, allicencelhetetlen és korlátozott jogot ad az Online Áruház használatára az Online Áruház által kifejezetten engedélyezett módszerek szerint, és az ÁÉF-ek által szabályozott módon. A Vásárlónak be kell tartania az Online Áruházban jelenlévő korlátozásokat, anélkül, hogy bármilyen módon megváltoztatná az Online Áruházat. Különösen, kivéve, ha ezt kötelező jogszabályok teszik lehetővé, a Vásárló tartózkodik a következő tevékenységektől például: az Online Áruház technikai korlátozásainak megkerülése; az Online Áruház dekódolása, dekompilálása vagy szétszerelése; stb.
2. Kifejezetten megértendő, hogy a GUESS fenntartja az összes olyan jogot, amelyet az ÁÉF-ek szerint kifejezetten nem licencel.
3. Kivéve, ha az ÁÉF-ek kifejezetten engedélyezik, a Vásárló nem használhatja az Online Áruházat: (i) bármilyen kereskedelmi szolgáltatás nyújtására; (ii) olyan termék fejlesztésére, amely versenyben áll az Online Áruházzal vagy a GUESS-szel; (iii) automatizált hozzáférési eszközök, például pókhálók vagy robotok használatára, vagy az Online Áruházzal kapcsolatos scraping tevékenységekre, vagy információk és adatok gyűjtésére az Online Áruházból; (iv) harmadik fél számára hozzáférést vagy az Online Áruház használatát, kivéve, ha az ÁÉF-ek másképp rendelkeznek; (v) saját bejelentkezési adatainak terjesztésére vagy közzétételére az Online Áruházban; vagy (vi) nem engedélyezett vagy harmadik fél bejelentkezési adatainak használatára.

Weboldal tartalma és használata - Szellemi tulajdon

1. Az Online Áruház és annak tartalma a GUESS és licenszadóin tulajdonát képezi.
2. Az Online Áruház és annak tartalma védett a szerzői jogokra, bejegyzett védjegyekre, tervekre és modellekre, szoftvervédelemre, adatbázisokra, domainnevekre vagy bármely más szellemi és ipari tulajdonjogokra vonatkozó nemzeti és nemzetközi törvényekkel.
3. A Vásárló nem reprodukálhatja, kivéve személyes használat céljából és az alkalmazandó törvények által meghatározott határokon belül, nem teheti közzé, nem közölheti a nyilvánossággal bármilyen kommunikációs eszközzel, nem továbbíthatja, nem hajthatja végre, nem jelenítheti meg, nem terjesztheti, nem távolíthatja el, nem törölheti, nem adhat hozzá, vagy másképp nem módosíthatja az Online Áruházat vagy annak tartalmát, nem hozhat létre belőlük ihletett vagy származtatott műveket, nem kereshet belőlük, és nem vehet részt aktívan azok kereskedelmében, kivéve, ha a GUESS kifejezetten és előre engedélyezi.
4. Kifejezetten tilos az Online Áruház és annak tartalmához való hozzáférés sértegetése, zavarása vagy megszakítása, vagy olyan cselekmények végrehajtása, amelyek megváltoztathatják annak működését vagy más felhasználók hozzáférését zavarhatják az Online Áruházhoz vagy annak tartalmához, valamint az Online Áruház vagy annak tartalmának illegális módon vagy a GUESS-nek és bármely harmadik félnek, beleértve az Online Áruház más felhasználóját is, káros módon történő használata.
5. Az Online Áruházból álló weboldalak lehetővé tehetik a hozzáférést, dedikált hiperhivatkozások (azaz linkek) segítségével harmadik fél weboldalaira vagy az interneten elérhető erőforrásokra. A GUESS nem felelős a hiperhivatkozásokon keresztül kapcsolódó harmadik fél weboldalainak tényleges elérhetőségéért, sem a Vásárlónak és/vagy felhasználóknak az ilyen weboldalakon keresztül nyújtott vagy megszerzett tartalmakkal, anyagokkal vagy termékekkel kapcsolatban felmerülő károkért.

Jótállás kizárása és felelősség korlátozása

1. Az Online Áruház használatával a Vásárló elismeri és elfogadja, hogy az Online Áruház „ahogy van” és „ahogy elérhető” állapotban kerül felkínálásra a használat időpontjában.
2. A GUESS az alkalmazandó jog maximális mértékéig, és a jelen szakasz rendelkezéseitől függetlenül, nem nyújt garanciát, kifejezett és/vagy feltételezett garanciát az Online Áruházra vonatkozóan, például kizárólag példaként csak, bármilyen káros szoftvertől (pl. malware és/vagy bármilyen típusú vírus, például fájlvírusok, bootvírusok, makróvírusok és hálózati vírusok) mentességre vagy bármilyen kereskedelmi forgalomra alkalmasságra vagy adott célra való megfelelőségre vonatkozó garanciát.
3. A GUESS semmilyen módon nem felelős az Online Áruház használatából, valamint a Termékek megvásárlásából és/vagy használatából eredő bármilyen kárért, kivéve, ha az alkalmazandó jog másképp rendelkezik.
4. Az Online Áruházból letöltött, létrehozott vagy másképpen megszerzett bármely tartalom a Vásárló saját felelősségére és kockázatára kerül megszerzésre. Ezért a Vásárló kizárólag felelős bármilyen eszközén keletkezett kárért vagy adatvesztésért, amely az Online Áruház használatából ered. Az alkalmazandó jog maximális mértékéig az Online Áruház használatával a Vásárló vállalja, hogy vállalja az ilyen használattal kapcsolatos összes kockázatot, és teljes felelősséget vállal bármilyen használatvesztésért, adatvesztésért és az Online Áruházzal kapcsolatban használt hardver és/vagy szoftver karbantartásához és/vagy javításához kapcsolódó költségekért, továbbá vállalja, hogy a GUESS-t semmilyen módon nem tartja felelősnek bármilyen kárért, amely az Online Áruház használatából vagy ahhoz kapcsolódóan keletkezik.
5. Az ÁÉF-ek bármely más rendelkezésétől függetlenül, a GUESS jótállásai és felelőssége nem zárhatók ki vagy korlátozhatók: (i) a GUESS cselekménye vagy mulasztása következtében a Vásárló életének vesztéhez vagy károsodásához vezető esetben; (ii) a GUESS gondatlansága vagy szándékos jogellenes magatartása esetén; (iii) bármely olyan felelősség vagy garancia esetén, amelyet a törvény nem korlátozhat vagy zárhat ki.

Kártérítés

Az alkalmazandó jog maximális mértékéig a vásárló kötelezi magát, hogy kártalanítja és mentesíti a GUESS-t, annak leányvállalatait, vezetőit, igazgatóit, tisztviselőit és jogutódjait minden olyan felelősség alól, amely bármilyen módon pénzügyi vagy nem pénzügyi veszteségből származik, amelyet bármely harmadik fél szenvedett el (i) az Online Áruház és a Termékek gondatlan használatából, vagy egyébként az ÁÉF bármely rendelkezésének megsértéséből, vagy (ii) bármely alkalmazandó jogszabály vagy bármely harmadik fél jogának megsértéséből.

Záró rendelkezések

1. Amennyiben az ÁÉF bármely rendelkezése érvénytelennek vagy hatástalannak bizonyul, ez nem teszi az ÁÉF-et teljes egészében érvénytelenné. Az érvénytelen rendelkezéseket más, érvényes rendelkezések helyettesítik, figyelembe véve a felek akaratát és az alkalmazandó jog által engedélyezett jelentést és tartalmat.
2. Az ÁÉF a Vásárló és a GUESS közötti teljes szerződést képezik, és felváltják az ÁÉF tárgyára vonatkozó összes korábbi vagy egyidejű feltételt, megállapodást vagy nyilatkozatot, szóban vagy írásban.
3. A Vásárló és a GUESS egyik sem minősül mulasztónak az ÁÉF-ek szerint bármilyen késedelem vagy teljesítési mulasztás miatt, amely a Vásárló vagy a GUESS ésszerű ellenőrzésén kívüli eseményből származik (az ún. „Felsőbbrendű erő”), feltéve, hogy az érintett fél ésszerű időben értesíti a másik felet a Felsőbbrendű erő állapotáról, és ésszerű erőfeszítéseket tesz a késedelem vagy a teljesítési mulasztás enyhítésére.
4. A GUESS külön figyelmet szentel és maximális figyelmet fordít a Vásárló személyes adatainak védelmére. A GUESS a személyes adatokat az alkalmazandó jogszabályok rendelkezéseinek megfelelően és az Online Áruházban elérhető „Adatvédelem” linken keresztül elérhető adatvédelmi szabályzatának megfelelően dolgozza fel, amely az ÁÉF szerves és alapvető részét képezi.
5. Az ÁÉF a magyar jog hatálya alá tartozik. Az ezekből eredő bármely vitára a Vásárló lakhelye szerint illetékes bíróság hatásköre vonatkozik.
