Conclusion of contract

Once the Customer places an order in the Online Shop, the Customer will send a contractual proposal of purchase to GUESS, which does not constitute the termination of the contract. GUESS will send a confirmation of receipt of the order to the Customer by e-mail. Such e-mail does not constitute an acceptance of the proposal, but only confirmation of receipt of the order, after which GUESS may confirm the availability of the Product(s) and, if applicable, verify the payment method indicated.

The contract for the sale and purchase of the Product(s) shall be deemed concluded when the Customer receives the e-mail of successful dispatch of the order, provided that the payment is successful, containing these GCS and information about the Product(s) ordered, including the price paid. If, for any reason, payment of the price is not successful, the order will not be processed and will be cancelled, and the contract will not be concluded.

To make any changes to an order, the Customer must contact Customer Service. GUESS reserves the right to accept, wholly or in part, the changes to the order requested by the Customer, provided that such changes are requested before the ordered products are shipped. Completion of the order form implies the acceptance of the offered price and the general terms and conditions of sale in force at the time. Once the order has been formalised, the purchase is understood to be fully concluded, with all legal guarantees for the protection of the purchasing consumer and, from that moment, the prices and conditions assume a contractual nature and cannot be modified without the express consent of both contracting parties. The language used for the formalisation of the contract shall be English.

Product prices

1. The prices of our products are expressed in Euros (EUR).
2. The prices shown in the Online Store include the VAT (Value Added Tax) in force at the time of the order.
3. The prices shown in the Online Store do not include the shipping costs, which shall be paid by the Customer. Shipping costs will be added to the final total price at the time of placing the relevant Order, according to the applicable shipping rates indicated in the Online Store. Additional shipping costs may apply. Any additional shipping costs, where applicable, will be duly indicated at the checkout stage and reported in the FAQ section
4. Payment by Customer may be made using any payment option available in the Online Store:
   1. Credit Card
   2. PayPal
   3. Klarna
   4. Apple Pay
   5. Google Pay

   In the event that the Customer makes use of payment services offered by third party operators (for example Klarna or Paypal), the Customer is required to read the terms and conditions governing such services.

5. Payment by credit card may be subject to the application of fees by the Customer's bank or the company that issued the credit card and the Customer may have more information about these fees by contacting their bank and the company issuing their credit card. GUESS remains totally unrelated to purchase transaction fees, which depend on the specific conditions applied, to its customers and users, by the providers of banking and payment services.

Right of withdrawal from a distance contract

1. The Customer, without having to provide any reason, may withdraw from the distance contract stipulated with GUESS and return the products purchased through the Online Store within 30 calendar days from the day of receipt of the products ordered or, in the case of products subject to the same order that have been received separately, from the day of receipt of the last product. In order to comply with the deadline for exercising the withdrawal, it is sufficient for the Customer to send Guess a relevant explicit written notice of their intention to withdraw from the contract within the 30-day period indicated above.
2. To exercise the right of withdrawal, Guess recommends activating the electronic procedure available in the MY ACCOUNT or RETURNS sections of the Online Store.

   Should the Costumer prefer not to make use of the aforementioned procedure, the notice of withdrawal from the contract may also be submitted using the following form, which, by way of illustration, outlines the information and data that must be provided to Guess in order to withdraw.

3. GUESS will promptly send the Customer an acknowledgment of receipt of the notice of withdrawal on a durable medium (for example, by email).
4. In case of withdrawal from the contract, GUESS shall reimburse the Customer for all payments received in connection with the order, including delivery costs, if incurred. Additional costs incurred by the Customer who has expressly chosen a delivery method other than the least expensive type offered by GUESS shall not be reimbursed.
5. Without prejudice to the paragraph 6 below, the reimbursement to the Customer shall be made by GUESS without delay, and, in any case, no later than 14 days from the day on which GUESS was informed of the Customer’s decision to withdraw. The timeframe for the actual crediting of the amount due to the Customer depends on the Customer’s credit institution or on third-party payment service providers (such as PayPal or Klarna) and is in no way managed or controlled by GUESS. GUESS shall reimburse the payment only to the Costumer who placed the order, using the same payment method chosen by the Customer at the time of the conclusion of the contract, unless the Customer has expressly agreed otherwise. In any case, the Customer shall not bear any costs in obtaining the reimbursement.
6. GUESS reserves the right to withhold the amount to be reimbursed until it receives the goods at the address indicated in paragraph 7 below, or until the Customer provides proof of shipment of the goods, whichever occurs first.
7. The products to be returned must be shipped to the following address GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Poland in a single shipment and within fourteen [14] calendar days from the day on which the Customer notified GUESS of their intention to withdraw from the contract. The products may be shipped using the return label automatically generated after completing the return registration procedure as described on the Online Store(or the return label otherwise provided by GUESS to the Customer together with the ordered products). The Customer may choose any method for returning the products and shall bear the related shipping costs. Customers who make use of GUESS’s return procedure are entitled to one (1) free return shipment per month. GUESS strongly recommends including the order number and order date in the return package, to allow GUESS to identify the shipment and proceed with the return process. The right of withdrawal does not apply to sealed products that are not suitable for return due to health protection or hygiene reasons and that have been opened after delivery: in such case, GUESS reserves the right to refuse the return, with the consequences set out in paragraph 9 below.
8. The Customer shall be liable for any reduction in the value of the product resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the product. This means that, following the Customer’s withdrawal from the contract, GUESS may seek compensation from the Customer for any damage caused by the return of products that are not intact or have been altered (e.g., damaged, washed, incomplete). All returned items must be unused and in their original condition, with all tags and labels intact.
9. Should GUESS refuse the return due to the ineligibility of the request (for example, if the time limit for the Customer to make the return has expired) or of the Product (for example, in the case of products that cannot be returned pursuant to paragraph 7 above), GUESS shall return the products to the Customer — unless the Customer explicitly communicates otherwise — at the Customer’s expense, and no reimbursement shall be issued.

Legal Warranty of Conformity

1. In the event of delivery of defective products by GUESS, according to the legal warranty, the Customer shall be entitled to the following remedies:
   1. price reduction;
   2. reimbursement of the price (termination of the contract);
   3. replacement of the defective products;
   4. repair of the products.
2. The warranty is valid for 3 (three) years starting from the date the products are delivered to the Customer. The action aimed at asserting defects not fraudulently concealed by GUESS must, in any case, be brought within thirty-eight months from the date of delivery of the Product. The Customer must report the defect to Guess within 2 months from the date the defect is discovered.
3. Unless proven otherwise, any lack of conformity that arises within one year from the delivery of the Product is presumed to have already existed at the time of delivery, unless this assumption is incompatible with the nature of the Product or the nature of the lack of conformity. After one year from the delivery of the Product, it will be the Customer’s responsibility to prove that the lack of conformity already existed at the time of delivery.
4. In order to benefit from the legal warranty, the Customer must provide proof of the purchase and date of delivery of the goods. Therefore, for this purpose, it is advisable that the Customer retains the purchase invoice, as well as the transport document or any other document that can certify the purchase and the date of delivery.
5. Notwithstanding the above, any faults or malfunctions caused by external and accidental events or by the Customer’s responsibility or by use of the Product that does not comply with its intended use and/or with the provisions of the documentation accompanying the Product are excluded from the scope of the legal warranty.
6. In the event of a lack of conformity covered by the legal warranty, the Customer is entitled to:
   1. (i) primarily, have the product repaired or replaced free of charge, at their choice, unless the requested remedy is objectively impossible or excessively onerous compared to the alternative;
   2. (ii) secondarily, a proportional price reduction or termination of the contract (with reimbursement by GUESS of the amount paid by the Customer for the purchase of the Product), at their choice, in the event that:
      • • GUESS has not carried out the repair or replacement, or has refused to do so because it is impossible or excessively onerous;
      • • a lack of conformity appears despite GUESS’s attempt to restore the conformity of the product;
      • • the lack of conformity is so serious as to justify the immediate price reduction or the termination of the sales contract; or
      • • GUESS has declared, or it is clear from the circumstances, that it will not restore the conformity of the product within a reasonable period of time or without significant inconvenience to the Customer.
7. Without prejudice to the other remedies, GUESS may oppose the termination of the contract if it proves that the lack of conformity is only minor.
8. In the event that the Customer, according to the legal warranty, requests a refund or a price reduction, the following provisions shall apply: upon receipt of the Products by Guess at the following address: GUESS DC10 – ul. Rabowicka 51A, 62-020 Jasin, Poland, and after GUESS has verified the existence of any defects, GUESS will send an email to the Customer confirming the receipt of the defective products, will give instructions for the refund to the bank or third-party payment service provider (such as PayPal or Klarna) requesting the refund of the price (total or partial) and of all shipping costs (including shipping costs for the return of the product) within no more than 14 days after the receipt of the refund. The actual time required for the amount to be credited to the Customer depends on the Customer’s bank or third-party payment service providers (such as PayPal or Klarna) and is beyond GUESS’s control.

Complaints

1. In order to file a complaint (for a defective product or for any other case), the Customer may:
   1. File a complaint online. To activate this option, the Customer must contact Customer Service at https://www.rag-bone.eu/-/need-help. Customer Service may request a photo of the products and the alleged defect. Customer Service reserves the right to make available to the Customer a courier label that will allow products to be sent to GUESS by courier at the expense of the latter. GUESS recommends the use of the online complaint form, which ensures immediate feedback for the Customer.
   2. As an alternative to the process illustrated in the preceding paragraph, the Customer may use the following form:

2. GUESS will respond to the Customer's complaint immediately, no later than 14 calendar days from its receipt. Failure to respond by GUESS within the aforementioned period implies the automatic acceptance of the Customer's complaint. GUESS will inform the Customer without delay of any unsuitability of the complaint and/or of any need to supplement it with missing information and data.
3. In any case, the possibility remains for the Customer to activate extrajudicial methods of handling complaints according to the online dispute resolution procedure prepared by the European Commission. The relevant platform is available at the following link: https://ec.europa.eu/consumers/odr.

License

1. With these GCS, GUESS grants the Customer a non-exclusive, non-transferable, non-sublicensable, and limited right to use the Online Store in accordance with the methods expressly permitted by the Online Store and governed by these GCS. The Customer must comply with any limitations present on the Online Store without altering in any way the Online Store. In particular, except as provided by mandatory legal provisions, the Customer will refrain from the following activities by way of example: bypassing technical limitations of the Online Store; decoding, decompiling, or disassembling the Online Store; etc.
2. It is expressly understood that GUESS reserves all rights not specifically licensed in accordance with these GCS.
3. Except as expressly permitted by these GCS, the Customer may not: (i) use the Online Store to provide any commercial service; (ii) use the Online Store to develop a product that competes with the Online Store or with GUESS; (iii) use automated access tools such as spiders or robots, or engage in scraping activities in relation to the Online Store, or collect information and data from the Online Store; (iv) allow third parties to access or use the Online Store unless otherwise provided by these GCS; (v) distribute or publish their Online Store login credentials; or (vi) use unauthorized or third-party login credentials.

Website content and use - Intellectual Property

1. The Online Store and its contents are property of GUESS and its licensors.
2. The Online Store and its contents are protected by the national and international laws regarding copyright, registered trademarks, designs and models, software protection, databases, domain names, or any other intellectual and industrial property rights legislation.
3. The Customer may not reproduce, except for purposes related to personal use and within the limits established by applicable laws, publish, communicate to the public by any means of communication, transmit, perform, display, distribute, remove, delete, add to, or otherwise modify the Online Store or its content, nor create works inspired by or derived from them, commercialize the Online Store and/or its content, or actively participate in their commercialization, unless expressly and in advance authorized by GUESS.
4. It is expressively prohibited to damage, interfere with or disrupt access to the Online Store and its content, or to perform actions that may alter its functionality or interfere with other users’ access of to the Online Store or its content, nor utilize the Online Store or its content in illegal manners or in a way harmful to GUESS and to any third party, including any other user of the Online Store.
5. The web pages that make up the Online Store may allow access, via dedicated hyperlinks (namely, links) to third-party website or resources available on the Internet. GUESS shall not be held liable for the actual accessibility of third-party websites linked through such hyperlinks, nor for any damages that may arise to the Customer and/or users in connection with the contents, materials or Products offered or obtained by the Customer through the said websites.

Exclusion of warranty and limitation of liability

1. Through the utilization of the Online Shop, the Customer acknowledges and agrees that the Online Shop is furnished “as it is” and “as available” at the time of fruition.
2. GUESS, to the fullest extent permitted by applicable law and without prejudice to the provisions of this section, does not provide any warranty, express and/or implied, in relation to the Online Shop, such as, by way of example only, any warranty of harmlessness from harmful software (i.e. malware and/or viruses of any kind and by way of example only file viruses, boot viruses, macro viruses and network viruses) or any warranty of merchantability or fitness for particular purposes.
3. GUESS cannot be held liable in any way for any damage deriving from the use of the Online Shop and from the purchase and/or use of the Products, unless otherwise provided for by applicable law.
4. Any content downloaded, created or otherwise acquired from or through the Online Shop is obtained at the sole and exclusive discretion and risk of the Customer. The Customer is therefore solely and exclusively liable for any damage to your devices or loss of data resulting from the use of the Online Shop. To the fullest extent permitted by applicable law, by using the Online Shop, the Customer undertakes to bear all the risks connected to such use and to assume full responsibility for any loss of use, loss of data and costs connected to any servicing and/or repair of the hardware and/or software used in connection to the Online Shop, also undertaking not to hold GUESS liable in any way for any damage arising from or caused by the use of this Online Shop or related to it.
5. Notwithstanding any other provision in this GCS, the warranties and liability of GUESS are not excluded or limited: (i) in case of death or damage to the Customer resulting from the act or omission of GUESS; (ii) in case of negligence or wilful misconduct of GUESS; (iii) for any other liability or warranty that cannot be limited or excluded by law.

Indemnity

To the fullest extent permitted by applicable law, the customer undertakes to indemnify and hold GUESS, its affiliates, administrators, directors, officers and assigns harmless from any and all liability resulting from pecuniary or non-pecuniary loss suffered by any third party in any way (i) arising from the negligent use of the Online Shop and the Products, or otherwise in breach of any article of these GCS, or (ii) arising from the breach of any applicable law or any third party right.

Final dispositions

1. In the event that any provision of these GCS is found to be invalid or ineffective, this shall not render these GCS invalid in its entirety. Any invalid provisions shall be replaced by other valid provisions, taking into account the will of the parties and the meaning and content permitted by applicable law.
2. These GCS comprise the entire agreement between the Customer and GUESS and supersede any previous or contemporaneous conditions, agreements or statements, whether oral or written, relating to the subject matter of these GCS.
3. Neither the Customer nor GUESS shall be deemed to be in fault under these GCS due to any delay or failure to perform its obligations resulting from any event beyond the reasonable control of the Customer or GUESS (so-called ‘Force Majeure’), provided that the party concerned notifies the other party in a reasonably timely manner of the Force Majeure condition and makes reasonable efforts to mitigate the delay or failure.
4. Guess takes into particular consideration and pays maximum attention to the protection of the Customer’s personal data. GUESS processes the Customer’s personal data in compliance with the provisions of the applicable law and in accordance with its privacy policy accessible at the link ‘Privacy’ that can be found in the Online Shop and that forms an integral and substantial part of these GCS.
5. These GCS are subject to Italian law. Any disputes arising therefrom shall be subject to the jurisdiction of the competent court based on the place of residence of the Customer.

Conclusione del contratto

Una volta che il Cliente ha effettuato un ordine nel Negozio Online, il Cliente invia una proposta contrattuale d’acquisto a GUESS, che non costituisce conclusione del contratto. GUESS invierà una conferma di ricezione dell'ordine al Cliente tramite e-mail. Tale e-mail non costituisce accettazione della proposta, ma esclusivamente conferma di aver ricevuto l’ordine a seguito del quale GUESS potrà verificare la disponibilità del/i Prodotto/i ed eventualmente verificare il metodo di pagamento indicato.

Il contratto di compravendita del/i Prodotto/i si considererà concluso quando il Cliente riceverà l’e-mail di avvenuta spedizione dell’ordine, purché il pagamento vada a buon fine, contenente le presenti CGV e le informazioni sul/i Prodotto/i ordinato/i, incluso il prezzo pagato. Qualora, per qualsiasi ragione, il pagamento del prezzo non dovesse andare a buon fine, l’ordine non sarà processato e sarà cancellato e il contratto non sarà concluso.

Per apportare eventuali modifiche ad un ordine, il Cliente deve contattare il Servizio Clienti. GUESS si riserva di accettare, in tutto od in parte, le modifiche all'ordine richieste dal Cliente, a condizione che tali modifiche siano richieste dal Cliente prima della spedizione dei prodotti ordinati. La compilazione del modulo d’ordine implica l’accettazione del prezzo offerto e delle condizioni generali di vendita vigenti al momento. Una volta formalizzato l’ordine, l’acquisto si intende pienamente concluso, con tutte le garanzie legali a tutela del consumatore acquirente e, da tale momento, i prezzi e le condizioni assumono natura contrattuale e non potranno essere modificati senza il consenso espresso di entrambe le parti contraenti. La lingua utilizzata per la formalizzazione del contratto sarà l’italiano.

Prezzi dei prodotti

1. I prezzi dei prodotti sono espressi in valuta euro (EUR).
2. I prezzi indicati nel Negozio Online sono comprensivi dell’Imposta sul Valore Aggiunto (IVA) nella misura in vigore al momento dell'ordine.
3. I prezzi nel Negozio Online non includono le spese di spedizione che sono a carico del Cliente. Le spese di spedizione verranno aggiunte al prezzo totale finale al momento dell'effettuazione dell'ordine, secondo le tariffe di spedizione applicabili indicate nel Negozio Online. Potranno essere applicati costi di spedizione aggiuntivi. Eventuali costi di spedizione supplementari, ove applicabili, saranno debitamente indicati nella fase di pagamento e riportati anche nella sezione FAQ.
4. Il pagamento da parte del Cliente può essere effettuato utilizzando una qualsiasi delle opzioni di pagamento disponibili nel Negozio Online. Nel caso il Cliente si avvalga di servizi di pagamento offerti da operatori terzi (per esempio Klarna o Paypal), il Cliente è tenuto a consultare i termini e condizioni che regolano tali servizi.
5. Il pagamento tramite carte di credito può essere soggetto all’applicazione di commissioni da parte della banca del Cliente o della società che ha emesso la carta di credito ed il Cliente potrà avere maggiori informazioni in merito a tali commissioni contattando la propria banca e la società emittente la propria carta di credito. GUESS rimane del tutto estranea rispetto alle commissioni legate alle operazioni d’acquisto, che dipendono dalle specifiche condizioni applicate, ai propri clienti ed utenti, dai fornitori dei servizi bancari e di pagamento.

Diritto di recesso da un contratto a distanza

1. Il Cliente, senza necessità di fornire alcuna motivazione, può recedere dal contratto a distanza stipulato con GUESS e restituire i prodotti acquistati tramite il Negozio Online entro 30 giorni di calendario decorrenti dal giorno di ricezione dei prodotti ordinati o, nel caso di prodotti oggetto dello stesso ordine che siano stati ricevuti separatamente, dal giorno di ricezione dell’ultimo prodotto. Ai fini del rispetto del termine per l’esercizio del recesso, è sufficiente che il Cliente invii a Guess una comunicazione esplicita della sua intenzione di recedere dal contratto entro il termine di 30 giorni su indicato.
2. Per esercitare il diritto di recesso, Guess consiglia di attivare la procedura elettronica disponibile nelle sezioni IL MIO ACCOUNT o RESI del Negozio Online.

   Qualora il Cliente preferisca non avvalersi della suddetta procedura, la dichiarazione di recesso dal contratto potrà essere effettuata anche utilizzando il seguente modulo, che, in via esemplificativa, riepiloga le informazioni ed i dati che occorre comunicare a Guess per recedere:

3. GUESS trasmetterà senza indugio al Cliente una conferma di ricevimento della comunicazione di recesso su supporto durevole (ad esempio tramite posta elettronica).
4. In caso di recesso dal contratto, GUESS rimborserà al Cliente tutti i pagamenti ricevuti a seguito dell’ordine, comprese, se sostenute, le spese di consegna. Non saranno rimborsati i costi supplementari sostenuti dal Cliente che abbia scelto espressamente un tipo di consegna diversa dal tipo meno costoso di consegna offerto da GUESS.
5. Fatto salvo quanto indicato al successivo comma 6, il rimborso al Cliente sarà disposto da GUESS immediatamente, e comunque non oltre 14 giorni dal giorno in cui GUESS è stata informata della decisione del Cliente di recedere. Le tempistiche per l'effettivo accredito dell'importo dovuto al Cliente dipendono dall’istituto di credito del Cliente o dai terzi fornitori di servizi di pagamento (quali PayPal o Klarna) e non sono in alcun modo controllate da GUESS. GUESS rimborserà il pagamento solo al Cliente che ha formalizzato l’ordine, utilizzando lo stesso mezzo di pagamento scelto dal Cliente al momento della conclusione del contratto, salvo che il Cliente abbia espressamente convenuto altrimenti. In ogni caso, il Cliente non dovrà sostenere alcun costo per ottenere il rimborso.
6. GUESS si riserva il diritto di trattenere l’importo da rimborsare fino a quando non riceverà i prodotti all’indirizzo indicato al successivo comma 7, o fino a quando il Cliente non fornirà una prova dell’avvenuta spedizione dei prodotti, a seconda della situazione che si verificherà per prima.
7. I prodotti da restituire devono essere spediti al seguente indirizzo GUESS DC10 - ul. Rabowicka 51A, 62-020 Jasin, Polonia con un'unica spedizione ed entro quattordici [14] giorni di calendario a decorrere dal giorno in cui il Cliente ha comunicato a GUESS la sua intenzione di recedere dal contratto. I prodotti possono essere spediti utilizzando l'etichetta di reso generata automaticamente dopo aver completato la procedura di registrazione del reso come descritta nel Negozio Online (o l'etichetta di reso altrimenti consegnata da GUESS al Cliente, insieme ai prodotti ordinati). Il Cliente può scegliere qualsiasi metodo per la restituzione dei prodotti e dovrà sostenere il relativo costo di spedizione. Ai Clienti che si avvalgono del processo di reso dei prodotti allestito da GUESS è offerta una (1) spedizione di reso gratuita al mese. GUESS consiglia vivamente di inserire nel plico di reso il numero e la data dell'ordine, in modo da consentire a GUESS di identificare la spedizione e dare corso alla procedura di reso. Il diritto di recesso non è previsto per i prodotti in imballo sigillato che non si prestano ad essere restituiti per motivi igienici o di tutela della salute e che siano stati aperti dopo la consegna: in tal caso, GUESS si riserva di rifiutare il reso, con le conseguenze descritte nel seguente comma 9.
8. Il Cliente è responsabile dell'eventuale riduzione di valore del prodotto risultante dal suo utilizzo oltre quanto necessario per stabilire la natura, le caratteristiche e il funzionamento del prodotto stesso. Quanto sopra comporta che GUESS, a seguito del recesso del Cliente dal contratto, potrà pretendere dal Cliente il risarcimento degli eventuali danni causati dalla restituzione di prodotti non integri od alterati (es. danneggiati, lavati, incompleti). Tutti gli articoli restituiti devono essere inutilizzati e nelle condizioni originali, con etichette e cartellini intatti.
9. Nel caso GUESS rifiuti il reso per inidoneità della richiesta (per esempio, se è decorso il termine per il Cliente per effettuare il reso) o del Prodotto (per esempio, nel caso di Prodotti che non possono essere resi ai sensi del comma 7 che precede), GUESS rispedirà i prodotti al Cliente, salvo espressa comunicazione del Cliente in senso contrario, a spese del Cliente e non sarà effettuato nessun rimborso.

Garanzia Legale di conformità

1. In caso di consegna di prodotti difettosi da parte di GUESS, ai sensi della garanzia legale, il Cliente avrà diritto ai seguenti rimedi:
   1. riduzione del prezzo;
   2. rimborso del prezzo (risoluzione del contratto);
   3. sostituzione dei prodotti difettosi;
   4. riparazione dei prodotti.
2. La garanzia ha una validità di 2 (due) anni che decorrono dalla data di consegna dei prodotti al Cliente. L’azione diretta a far valere i difetti non dolosamente occultati da GUESS si prescrive, in ogni caso, nel termine di ventisei mesi dalla consegna del Prodotto. Il Cliente dovrà denunciare il difetto a GUESS entro 2 mesi dalla data della scoperta del difetto.
3. Salvo prova contraria, si presume che i difetti di conformità che si manifestano entro un anno dalla consegna del Prodotto esistessero già a tale data, a meno che tale ipotesi sia incompatibile con la natura del Prodotto o con la natura del difetto di conformità. Decorso un anno dalla consegna del Prodotto, sarà invece onere del Cliente provare che il difetto di conformità esisteva già al momento della consegna dello stesso.
4. Per poter usufruire della garanzia legale il Cliente dovrà quindi fornire prova dell’acquisto e della data di consegna del bene. Pertanto, è opportuno che, a fini di tale prova, il Cliente conservi la fattura di acquisto, nonché il documento di trasporto ovvero qualsiasi altro documento che possa attestare l’effettuazione dell’acquisto e la data della consegna.
5. Fermo restando quanto sopra, sono esclusi dal campo di applicazione della garanzia legale eventuali guasti o malfunzionamenti determinati da fatti esterni e accidentali o da responsabilità del Cliente ovvero da un uso del Prodotto non conforme alla sua destinazione d'uso e/o a quanto previsto nella documentazione allegata al Prodotto.
6. In caso di difetto di conformità rientrante nella garanzia legale, il Cliente ha diritto:
   1. (i) in via primaria, alla riparazione o sostituzione gratuita del bene, a sua scelta, salvo che il rimedio richiesto sia oggettivamente impossibile o eccessivamente oneroso rispetto all’altro;
   2. (ii) in via secondaria, alla riduzione proporzionale del prezzo o alla risoluzione del contratto (con il rimborso da parte di GUESS di quanto da pagato dal Cliente per l’acquisto del Prodotto), a sua scelta, nel caso in cui:
      • • GUESS non ha effettuato la riparazione o la sostituzione, oppure si è rifiutato di effettuarla in quanto impossibile o eccessivamente oneroso;
      • • si manifesta un difetto di conformità, nonostante il tentativo di GUESS di ripristinare la conformità del bene;
      • • il difetto di conformità è talmente grave da giustificare l'immediata riduzione del prezzo o la risoluzione del contratto di vendita; oppure
      • • GUESS ha dichiarato, o risulta chiaramente dalle circostanze, che non procederà al ripristino della conformità del bene entro un periodo ragionevole o senza notevoli inconvenienti per il Cliente.
7. Senza pregiudizio per gli altri rimedi, GUESS può opporsi alla risoluzione del contratto se prova che il difetto di conformità è solo di lieve entità.
8. Nel caso in cui il Cliente, ai sensi della garanzia legale, chieda il rimborso o la riduzione del prezzo, si applicano le seguenti disposizioni: al ricevimento da parte di Guess dei Prodotti al seguente indirizzo: GUESS DC10 - ul. Rabowicka 51A, 62-020 Jasin, Polonia e previa verifica da parte di GUESS degli eventuali difetti, GUESS invierà un'e-mail al Cliente confermando di aver preso atto della restituzione dei prodotti difettosi, darà istruzioni per il rimborso alla banca o al fornitore di servizi di pagamento di terze parti (come PayPal o Klarna) ordinando la restituzione del prezzo (totale o parziale) e di tutte le spese di spedizione (comprese le spese di spedizione per la restituzione del prodotto) entro e non oltre 14 giorni dal ricevimento del rimborso. I tempi di effettivo accredito dell'importo dovuto al Cliente dipendono dall’istituto di credito del Cliente o dai terzi fornitori di servizi di pagamento (quali PayPal o Klarna) e non sono in alcun modo controllati da GUESS.

Reclami

1. 1. Al fine di presentare un reclamo (per un prodotto difettoso o per qualsiasi altro caso), il Cliente può:
   1. Presentare un reclamo online. Per attivare questa opzione, il Cliente deve contattare il Servizio Clienti all’indirizzo https://www.rag-bone.eu/-/need-help. Il Servizio Clienti potrà richiedere la foto dei prodotti e del presunto difetto. Il Servizio Clienti si riserva di mettere a disposizione del Cliente un'etichetta per il corriere che consentirà l’invio a GUESS dei prodotti tramite corriere a spese di quest’ultima. GUESS raccomanda l'uso del modulo on-line di presentazione dei reclami, che assicura un immediato riscontro per il Cliente.
   2. In alternativa rispetto al processo illustrato al paragrafo che precede, il Cliente potrà avvalersi del seguente modulo:

2. GUESS risponderà al reclamo del Cliente immediatamente, entro e non oltre 14 giorni di calendario dal suo ricevimento. La mancata risposta da parte di GUESS entro il suddetto termine implica l’automatico accoglimento del reclamo del Cliente. GUESS informerà senza indugio il Cliente dell’eventuale inidoneità del reclamo e/o dell’eventuale necessità di integrarlo con informazioni e dati mancanti.
3. In ogni caso resta ferma la possibilità per il Cliente di attivare modalità extragiudiziali di gestione dei reclami secondo la procedura di risoluzione delle controversie online predisposta dalla Commissione Europea. La relativa piattaforma è disponibile al seguente link: https://ec.europa.eu/consumers/odr.

Licenza

1. Con le presenti CGV, GUESS concede al Cliente il diritto non esclusivo, non trasferibile, non sub-licenziabile e limitato di utilizzare il Negozio Online conformemente alle modalità di uso espressamente consentite dal Negozio Online e disciplinate dalle presenti CGV. Il Cliente dovrà attenersi a qualsiasi limitazione presente sul Negozio Online senza alterare in alcun modo il Negozio Online stesso. In particolare, salvo quanto previsto da disposizioni inderogabili di legge, il Cliente si asterrà, a titolo esemplificativo, dalle seguenti attività: aggirare le limitazioni tecniche presenti sul Negozio Online; decodificare, decompilare o disassemblare il Negozio Online; ecc.
2. È espressamente inteso che GUESS si riserva tutti i diritti non specificamente licenziati in conformità alle presenti CGV.
3. Salvo quanto espressamente consentito dalle presenti CGV, il Cliente non può: (i) usare il Negozio Online per fornire qualsiasi servizio commerciale; (ii) usare il Negozio Online per sviluppare un prodotto che sia in concorrenza con il Negozio Online o con GUESS; (iii) utilizzare strumenti di accesso automatico, come spider o robot, oppure effettuare attività di scraping in relazione al Negozio Online o raccogliere informazioni e dati dal Negozio Online; (iv) consentire a terzi l’accesso o l’utilizzo del Negozio Online, salvo quanto eventualmente previsto nelle presenti CGV; (v) distribuire o pubblicare le proprie credenziali di accesso al Negozio Online; o (vi) usare credenziali di accesso non autorizzate o di terzi.

Contenuti ed utilizzo del Sito – Proprietà intellettuale

1. Il Negozio Online e i contenuti sono di proprietà di GUESS o dei suoi licenzianti.
2. Il Negozio Online e i contenuti sono protetti dalla normativa nazionale e internazionale in materia di diritto d’autore, di marchi registrati, di disegni e modelli, di protezione del software, dei database e dei nomi a dominio o da qualsiasi altra normativa sui diritti di proprietà intellettuale ed industriale.
3. Il Cliente non può riprodurre, salvo che per finalità connesse all’uso personale e nei limiti previsti dalle vigenti leggi applicabili, pubblicare, comunicare al pubblico con qualsiasi mezzo di comunicazione, trasmettere, eseguire, rappresentare, distribuire, esporre, rimuovere, cancellare, aggiungere ovvero in qualsiasi altro modo modificare il Negozio Online o i contenuti, nonché creare opere a essi ispirate o derivate dagli stessi, commercializzare il Negozio Online e/o i contenuti e/o prendere parte attivamente alla loro commercializzazione, salvo che non vi sia espressa e preventiva autorizzazione di GUESS.
4. È espressamente vietato danneggiare, interferire o interrompere l’accesso al Negozio Online e ai contenuti, o compiere azioni che potrebbero alterare la funzionalità o interferire con l’accesso di altri utenti al Negozio Online o ai contenuti, nonché utilizzare il Negozio Online o i contenuti in modo illegale o dannoso per GUESS, o per qualsiasi terzo, incluso qualsiasi altro utente del Negozio Online.
5. Le pagine web di cui si compone il Negozio Online potrebbero consentire l’accesso, attraverso collegamenti ipertestuali dedicati (c.d. links), a siti web o risorse di terzi presenti nella rete internet. GUESS non potrà essere ritenuta responsabile della concreta raggiungibilità dei siti di terze parti collegati attraverso i links, né per eventuali danni che dovessero derivare al Cliente e/o agli utenti in relazione ai contenuti o ai materiali o ai Prodotti offerti o dal Cliente ottenuti attraverso i suddetti siti.

Esclusione di garanzia e limitazione di responsabilità

1. Mediante l’uso del Negozio Online, il Cliente riconosce e accetta espressamente che il Negozio Online è fornito “come è” e “come disponibile” al momento della sua fruizione.
2. GUESS, nei limiti massimi previsti dalla legge applicabile e fermo restando quanto previsto dalla presente sezione, non fornisce alcuna garanzia, esplicita e/o implicita, in relazione al Negozio Online quali, a mero titolo esemplificativo, qualsiasi garanzia di incolumità da software dannosi (i.e. malware e/o virus di qualsiasi tipo e solo a titolo esemplificativo file virus, boot virus, macro virus e network virus) o garanzie di commerciabilità o di idoneità a scopi particolari.
3. GUESS non potrà essere ritenuta in alcun modo responsabile di danni derivanti dall’uso del Negozio Online e dall’acquisto e/o dall’utilizzo dei Prodotti, salvo quanto inderogabilmente previsto dalla legge applicabile.
4. Qualsiasi contenuto scaricato, creato o altrimenti acquisito dal o per il tramite del Negozio Online è ottenuto a sola ed esclusiva discrezione del Cliente e a suo esclusivo rischio. Il Cliente è dunque il solo ed esclusivo responsabile per ogni danno eventualmente occorso ai tuoi dispositivi o per la perdita di dati derivante dall’utilizzo del Negozio Online. Nei limiti massimi inderogabilmente previsti dalla legge applicabile, attraverso l’utilizzo del Negozio Online il Cliente si impegna a farsi carico di tutti i rischi connessi a tale utilizzo e ad assumersi la piena responsabilità dell’eventuale mancato utilizzo, della perdita di dati e dei costi connessi alle eventuali attività di assistenza e/o riparazione dell’hardware e/o del software impiegati in relazione al Negozio Online, impegnandoti altresì a non ritenere GUESS responsabile in alcun modo di eventuali danni derivanti o causati dall’uso del presente Negozio Online o a esso relativi.
5. Indipendentemente da qualsiasi altra disposizione nelle presenti CGV, le garanzie e la responsabilità di GUESS non sono escluse o limitate: (i) in caso di morte o danno al Cliente risultanti da fatto o da un’omissione di GUESS; (ii) in caso di negligenza o dolo di GUESS; (iii) per qualsiasi altra responsabilità o garanzia che, per legge, non può essere limitata o esclusa.

Manleva

Nei limiti massimi previsti dalla legge applicabile, il Cliente si impegna a manlevare e tenere indenne GUESS, le sue affiliate, amministratori, dirigenti e aventi causa da ogni e qualunque responsabilità derivante dai danni patrimoniali e non, subiti da questi o da qualsiasi terzo e in qualunque modo (i) derivanti dall’utilizzo negligente del Negozio Online e dei Prodotti, o comunque in violazione di un qualsiasi articolo delle presenti CGV, o (ii) derivanti dalla violazione di qualsiasi norma di legge applicabile o di qualsiasi diritto di terzi.

Disposizioni finali

1. Nel caso in cui una qualsiasi disposizione delle presenti CGV dovesse risultare non valida od inefficace, ciò non comporterà l'invalidità totale delle presenti CGV. Le eventuali disposizioni invalide saranno sostituite da altre disposizioni valide, tenendo conto della volontà delle parti e del significato e del contenuto consentiti dalla legge applicabile.
2. Le presenti CGV costituiscono l’intero accordo tra il Cliente e GUESS e sostituiscono qualsiasi precedente o contemporanea condizione, accordo o dichiarazione, sia verbale che scritta, relativa alla materia oggetto delle presenti CGV.
3. Né il Cliente né GUES saranno considerati inadempienti ai sensi delle presenti CGV, a causa di un ritardo o della mancata esecuzione della sua obbligazione, risultante da qualsiasi evento al di fuori del ragionevole controllo del Cliente o di GUESS (cd. “Forza Maggiore”) a condizione che la parte interessata dia comunicazione alla controparte in modo ragionevolmente tempestivo della condizione di Forza Maggiore e compia ragionevoli sforzi per ridurre il ritardo o l’inadempimento.
4. GUESS tiene in particolare considerazione e presta la massima attenzione alla protezione dei dati personali del Cliente. GUESS effettua il trattamento dei dati personali del Cliente in conformità con quanto stabilito dalla legge applicabile e secondo quanto previsto dalla propria informativa sulla privacy accessibile al link “Privacy” reperibile sul Negozio Online e che forma parte integrante e sostanziale delle presenti CGV.
5. Le presenti CGV sono soggette alla legge Italiana. Eventuali controversie da esse derivanti saranno soggette alla giurisdizione del tribunale competente in base al luogo di residenza del Cliente.
